Swain County Release Records
A Swain County jail release record documents the end of one local custody episode. It does not always mean the person returned to the community. Someone may leave the Swain County Sheriff’s Office & Jail on bond, after time served, at sentence expiration, under a court order, or after dismissal or acquittal. Another exit may be a transfer to the North Carolina Department of Adult Correction, a different county, federal custody, ICE, or a separate tribal jurisdiction. Read Swain County Release Fields
A focused request should tie one person to one booking. Use the full name, date of birth, approximate booking date, booking number, and case number when known. The best response identifies the intake and exit times, release disposition, charges and case identifiers, and any receiving agency or destination field maintained and public. Ask for the code legend when abbreviations appear. A booking photo may be requested with the same number, but it proves intake provenance, not the case outcome or release.

Online visibility and retention differ. No Swain County roster or archive was found, so no web window can be measured. The state sheriff schedule’s item 53 covers entry and release summaries, release orders, work-release records, and related files. It authorizes destruction three years after release or transfer, subject to legal holds and local use. It does not prove every file is destroyed on that anniversary.

Ask for an existing record, not a new narrative or custom calculation. Ordinary copy charges are limited to actual direct reproduction cost, while unusually extensive work may support a special service charge. No Swain-specific fee schedule was found, so request an estimate.
Swain Release Record Access Law
G.S. 132-1 broadly defines public records made or received in public business, subject to other laws. G.S. 132-6 governs inspection and copying at reasonable times. When public and confidential material are mixed, request the separable public portion. An agency need not create a report it does not possess.
Criminal investigative material, juvenile and medical information, protected identifiers, victim information, sealed matters, and expunged records can receive special treatment. Expunction is a court remedy, not routine roster aging. An absent Swain court record may be sealed, confidential, juvenile, or expunged, so absence alone proves no release fact.
North Carolina’s Judicial Branch says an expunction removes a charge or conviction and seals or destroys the covered state records. Eligibility and wait periods depend on the disposition, offense, age, prior record, and governing statute. Petitions generally go to the clerk in the county of charge or conviction. The Judicial Branch reports a generally applicable filing fee of $175, with statutory exceptions that include some dismissal and not-guilty paths, and warns that processing may take months. A later expunction order can change court access, but it does not convert an old private copy into a reliable statement of present status.
Match Swain Court and Release Records
The Swain clerk and jail answer different questions. The North Carolina eCourts Portal can show bond, disposition, judgment, sentence, and orders. The jail event gives the actual exit time and whether movement was release or transfer. A court order can precede processing, and a closed case label is not a custody status.
Search by case number when possible. Otherwise match name, date of birth, location, case type, and dates. Obtain a signed order from the Swain Clerk of Superior Court if the summary is unclear. The clerk’s number is 828-488-7400, while the jail’s is 828-488-0159.

Find Released Swain County Inmates
Begin with the system that held the person. Swain County has no official online roster, released-inmate tab, booking archive, or recent-release feed located in the research sweep. A current roster would track people still held, not serve as a history of Swain County released inmates. The official fallback is jail confirmation, a focused request, VINE corroboration, and the matching court case.
- Identify the custody episode, arresting agency, booking facility, dates, and matching identifiers.
- Call the Swain jail and ask whether the terminal event was release or transfer.
- Read the Swain court case for bond, dismissal, judgment, sentence, or another order.
- Check VINE for the same agency record and treat the event as agency-scoped corroboration.
- If transferred, search NCDAC, another county, BOP, ICE, federal court, or the correct tribal system.
- Check parole, probation, or post-release supervision separately from physical custody.
Why the name is gone: A live list drops a person after the jail closes or transfers that episode. Disappearance does not identify the destination.
NCDAC Swain Release Search
The NCDAC Offender Public Information search covers North Carolina state imprisonment and public supervision history, including records back to 1972. It excludes county and city jail records. Use it for a person transferred from Swain County to state custody or released from a North Carolina prison. A blank result does not disprove a short Swain jail stay.

Projected Release Date is an estimate, not proof of exit. Actual Release Date is retrospective. Inmate Status addresses imprisonment, while Probation/Parole/Post Release Status may remain active outside prison. Last Movement can mean transfer. The separate NCDAC Inmate Releases search uses county, year, and month. It indexes state-prison releases, not a rolling Swain jail list.
Swain County Recent Release Limits
No official Swain County 24-hour or 72-hour feed was located through July 30, 2026. The Sheriff & Jail page is contact-oriented and has no visible roster, release tab, archive, or gallery. The Released Last 24 Hours page therefore gives the direct confirmation chain instead of promising a list.
The sheriff promotes an OCV app and Facebook page. Public app descriptions support tips, interaction, and news, but do not promise inmate lookup, release lists, or mugshots. Facebook is supplementary news, not an archive. NCDAC’s monthly state-prison release tool cannot fill this gap because it covers a different custody system.
Swain County Release Supervision
Physical release and correctional discharge are separate. Probation is imposed by a court and may allow community supervision. Post-release supervision follows the prison part of covered modern felony sentences. Parole is conditional release tied chiefly to older and specially governed sentences. Bond from the Swain jail is none of these by itself.

Verify the person in OPI and read the separate supervision status. North Carolina also maintains an absconder search. An absconder result signals an unresolved issue, not discharge, and detailed officer information may remain privileged.
Swain Release Alerts and Federal Checks
NC VINE searches one person by exact name or custody ID. Confirm age, birth date, identifier, and agency. A released event means that contributor no longer reports custody. It does not exclude NCDAC, another county, ICE, federal, or tribal custody. A missing result is inconclusive. NC SAVAN’s automated line is 1-877-627-2826.
For sentenced federal custody, the BOP locator can show RELEASED and a date for covered records, generally people released after 1982. It does not cover the Swain jail, NCDAC, or every USMS pretrial detainee. Use the federal docket and release order for USMS pretrial release. The state sex-offender registry is also narrow and is not a list of all Swain County released inmates.
VINE notification registration is tied to a verified person and record. Select the matching record, choose the offered phone, email, text, or app channel, provide the requested contact, and finish the confirmation or PIN prompts. NCDAC guidance says county-jail and DAC or OPUS identifiers can differ, so registration may be needed on each offender ID. Telephone registrants use a PIN, and official policy says calls repeat at set intervals for 24 hours when the PIN is not entered. Treat each alert as a reason to recheck the reporting custodian.
Getting Home After Swain Release
The jail is at 95 Brendle Street, while the county’s Swain Transit office is at 125 Brendle Street and lists 828-488-3213. The nearby addresses make Transit useful to call when planning a ride. No jail pickup, fare, release partnership, same-day availability, or walk-in service was verified.
Call before relying on transportation. Administrative hours do not establish release-processing times. No official exit door, waiting area, weekend schedule, or property-return workflow was found. Plans should remain flexible until the jail confirms the event.
Swain Release or ICE Transfer
An immigration detainer can make a county departure a transfer. The ICE Online Detainee Locator covers current ICE custody and people released from it within 60 days. Search by nine-digit A-number and country of birth, or exact name and country with optional birth date.
A current result supports continued ICE custody. A recent released result applies only to ICE custody. No result after 60 days is inconclusive, and a detainer does not prove a handoff occurred. No dedicated ICE center or county ICE detention contract was verified in Swain County.

Swain County Release Facility
The map contains one county detention entry: the Swain County Sheriff’s Office & Jail, also called the Law Enforcement Center. Bryson City Police may arrest inside city limits, but the county identifies no separate city jail. The booking facility creates the custody and release record.
No NCDAC prison, BOP institution, or dedicated ICE center was verified in the county. Those systems matter when a record shows transfer. The Qualla Boundary has a distinct jurisdiction, so county and tribal records should not be merged without case-specific proof.
Swain Release Facility Names
The county calls the Hughes Branch building its new Law Enforcement Center, opposite Ingles. It combines sheriff and jail functions and has capacity for up to 109 people. Capacity is a facility fact, not a current inmate count. “Swain County Jail,” “Sheriff’s Office & Jail,” and “Law Enforcement Center” may identify the same site.
Use both jail wording and the Law Enforcement Center name in a records request. This helps staff associate records made under different labels. The name does not change the custody test: the jail event shows how the episode ended, and the receiving system shows whether custody continued.
That distinction is especially useful when records conflict. If the jail says transfer and OPI becomes active, match the offender number, conviction county, admission, and movement before describing the person as transferred to NCDAC. If OPI later shows an Actual Release Date with an active post-release status, prison custody ended but community supervision continues. When OPI displays only a Projected Release Date, release has not been proved. Credits, discipline, corrected jail credit, a new commitment, revocation, or an amended judgment can change that projection.
